Welcome. These Terms of Service ("Terms") govern your use of https://www.jvshealth.com (the "Site") and the information, tools, and communications we provide through it. Please read them. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms work together with our Privacy Policy and Cookie Policy, which are incorporated here by reference.

1. Who We Are

JVS Health, LLC ("JVS Health," "we," "us," or "our") is a healthcare organization selected by the Centers for Medicare & Medicaid Services ("CMS") to participate in the GUIDE Model — Guiding an Improved Dementia Experience — a federal program supporting families caring for someone living with dementia.

Through the GUIDE Model we provide care navigation, caregiver education and support, respite care coordination, and access to a 24/7 caregiver helpline for families who qualify.

We are a participant in a CMS program. We are not a government agency, and this Site is not operated or endorsed by CMS, Medicare, or any federal or state government agency. Information about the GUIDE Model on this Site is provided by JVS Health and is not an official government communication. For official information about Medicare, visit medicare.gov.

2. Eligibility to Use This Site

You must be at least 18 years old and located in the United States to use this Site or request services. By using the Site, you represent that you meet these requirements.

If you are using the Site on behalf of another person — for example, as a family caregiver, legal representative, or authorized agent — you represent that you have the authority to do so and to provide any information you submit about that person.

3. This Site Does Not Provide Medical Advice

The Site is for general information and scheduling. It is not a substitute for professional medical advice, diagnosis, or treatment.

Nothing on this Site creates a physician-patient or clinician-patient relationship between you and JVS Health. Content on the Site — including information about dementia, caregiving, Medicare, or the GUIDE Model — is educational in nature.

Always seek the advice of a qualified health provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read here.

If you are experiencing a medical emergency, call 911 immediately. Do not use this Site, our forms, or our text messaging program to report an emergency.

4. Eligibility Checks Are Preliminary

The Site and related pages may offer a way to check whether you or the person you care for may qualify for the GUIDE Model.

Any result you receive is a preliminary indication only. It is not a determination of eligibility, a guarantee of enrollment, or a promise of benefits.

Final eligibility depends on verification of Medicare coverage, clinical criteria, geographic service area, program capacity, and CMS requirements. It is confirmed only after review by our care team and, where applicable, verification with Medicare. We may be unable to enroll you even if a preliminary check suggested you might qualify.

Eligibility information you provide must be accurate and complete. Submitting inaccurate information may delay or prevent enrollment.

5. Cost

Services provided under the GUIDE Model are covered by Medicare for qualifying beneficiaries, and there is no cost to those families for GUIDE services. Your regular Medicare coverage and benefits are not changed by participating.

This does not mean every service JVS Health may offer is free. If a service carries a cost, we will tell you before you incur it.

6. Appointments and Scheduling

You may schedule appointments through the Site or through links we provide. Please arrive prepared and on time, and let us know as early as you can if you need to cancel or reschedule.

We may need to reschedule or cancel an appointment — for example, if eligibility cannot be verified, if clinical staffing changes, or if the information provided at scheduling turns out to be inaccurate. If we cancel an appointment, we will tell you and explain why. We will not cancel silently.

7. Communications, Email, and Text Messaging

By providing your contact information, you agree that we may contact you about the services you requested.

Email

We may send you service-related email about scheduling, enrollment, and your care. You may unsubscribe from marketing email at any time using the link in any message. Service-related messages will continue.

Text Messaging (SMS) Terms

These SMS terms form part of these Terms of Service.

Program. JVS Health, LLC sends text messages to individuals who have provided a mobile number and agreed to receive them. Messages relate to the GUIDE dementia care program and include appointment scheduling and reminders, care navigation follow-up, enrollment and paperwork reminders, and replies to questions you send us. This is a two-way conversational program — you may receive replies from our care team.

How to opt in. By submitting your mobile number through a form on our Site with the SMS consent box selected, by giving verbal consent on a recorded call with our team, or by texting us first. Consent to receive text messages is not a condition of receiving our services.

Message frequency. Message frequency varies based on your interaction with us and the status of your enrollment.

Cost. Message and data rates may apply. JVS Health does not charge for these messages; your mobile carrier may.

To opt out. Reply STOP to any message. You will receive one confirmation message and nothing further. You may opt back in at any time by texting START.

For help. Reply HELP to any message, or reach us through our Contact Us page.

Carriers. Carriers are not liable for delayed or undelivered messages.

Privacy.Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Marketing messages. Where you have separately consented, we may send information about other programs, products, and services offered by JVS Health or by companies we own or partner with. All such messages are sent by JVS Health. Your mobile number is never provided to another company to contact you. You may opt out of these at any time by replying STOP.

Emergencies. Do not use text messaging to report a medical emergency. Call 911.

8. Information You Provide

You agree that information you submit through the Site is accurate, complete, and that you have the right to provide it — including any information about another person you care for.

Please do not submit detailed medical records or sensitive clinical information through general website forms. If we need clinical information, we will tell you how to provide it securely.

Where JVS Health acts as a HIPAA covered entity or business associate, protected health information is governed by HIPAA and by our Notice of Privacy Practices, which is provided separately and controls over these Terms in the event of a conflict.

9. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose, or in violation of these Terms

  • Submit false, misleading, or fraudulent information, including in an eligibility check

  • Impersonate another person or misrepresent your authority to act for someone

  • Attempt to gain unauthorized access to the Site, our systems, or another user's information

  • Interfere with the operation or security of the Site, including through scraping, automated access, or malicious code

  • Copy, reproduce, or redistribute Site content except as permitted in Section 10

We may suspend or terminate access to the Site for any violation of these Terms.

10. Intellectual Property

The Site and its content — text, graphics, logos, images, and software — are owned by JVS Health or our licensors and are protected by copyright, trademark, and other laws.

You may view, download, and print Site content for your own personal, non-commercial use in connection with your care or the care of someone you support. All other use requires our written permission.

11. Third-Party Links and Services

The Site links to and integrates with services operated by others — including scheduling, forms, and communication tools. Those services are governed by their own terms and privacy policies, and we do not control them.

We provide links for convenience. A link is not an endorsement, and we are not responsible for the content, accuracy, or practices of any third-party site or service.

12. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, JVS Health disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, timely, secure, or error-free.

We do not warrant the accuracy or completeness of information on the Site, including information about Medicare or the GUIDE Model, which may change.

This section does not disclaim any warranty or liability that cannot be disclaimed under applicable law, and nothing in these Terms limits our obligations regarding the quality of clinical care we actually provide.

13. Limitation of Liability

To the fullest extent permitted by law, JVS Health and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Site — even if we have been advised of the possibility.

Our total liability arising out of or relating to the Site will not exceed one hundred dollars ($100).

These limits do not apply to claims arising from clinical care provided by JVS Health, to gross negligence or willful misconduct, or to any liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless JVS Health from any claims, losses, and reasonable expenses arising from your violation of these Terms, your misuse of the Site, or your submission of information you were not authorized to provide.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute not otherwise resolved will be brought in the state or federal courts located in Suffolk County, New York, and you consent to that jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. The effective date at the top shows when they were last revised. Material changes will be posted on this page. Your continued use of the Site after an update means you accept the revised Terms.

17. Termination

We may suspend or end your access to the Site at any time, with or without notice, for any reason — including violation of these Terms. Sections 8 through 15 survive termination.

18. General

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and JVS Health regarding the Site.
